“Netflix sued” would mean they are being sued, “Netflix sues” means they are doing the suing.

Unless it’s something that happened in the past…

You often constructions like:

You won’t believe what happened next!

“Netflix [had] sued” is as reasonable as “Netflix [was] sued,” is it not?
